General terms and conditions

Perkova ulica 17, 1230 Domžale, Slovenia, Europe, tax number SI98130161 (the company is a taxable person), registration number 8657122000, entered at the District Court of Ljubljana on June 9th 2020, the number of entry of the company in the court register is Srg 2020/15572, business account opened with SKB BANKA d.d., Ajdovščina 4, 1513 Ljubljana, Slovenia, IBAN SI56 0310 4100 0830 772, BIC (SWIFT) SKBASI2X.

The general terms and conditions of the online boutique AMAREEN (hereinafter: terms of business) are compiled in accordance with the Consumer Protection Act of Slovenia (hereinafter: ZVPot), with the recommendations of the Chamber of Commerce and Industry of Slovenia and international codes for e-commerce. These Terms and Conditions cover the operations, the rights of the user and the business relationship between the Seller and the buyer.

You must be over 18 years of age to purchase from the online boutique AMAREEN.

The company undertakes not to set any contractual terms that would be unfair to the consumer, in accordance with the provisions of ZVPot (under Slovenian law). Unfair contract terms are void.

These terms and conditions are published on the online boutique AMAREEN in the ”Terms and Conditions” section in the footer of the page; they are also kept in physical form at the company’s headquarters. By publishing on the website, it is considered that the general terms and conditions are known to the buyer, and by concluding the sales contract, the buyer declares that he has read the general terms and conditions and is fully acquainted with them.

CHANGES TO THE GENERAL TERMS AND CONDITIONS

The company undertakes that any change to the general terms and conditions will be published on the online boutique AMAREEN with the effective date of the change. The general terms and conditions are binding in that form and regarding the content that was available to the parties on the day of concluding the contract. In the event of a change in the general terms and conditions, the changes become binding for the customer from the day he becomes acquainted with them.

The customer is considered to be aware of the changes at the time the change is posted on the online boutique AMAREEN and upon receipt of the notification of the change. By doing so, the buyer is deemed to agree to the change in the general terms and conditions. If the buyer declares that he does not agree with the changed terms of business, the company has the right to withdraw from the contract.

In the event that an individual provision in the contract or general terms and conditions would be invalid or unenforceable or if a legal loophole would arise, this does not affect other provisions in the contract or general terms and conditions, with both parties agreeing that instead of the invalid or unenforceable or non-existent provision, a provision nearest to the purpose or objective of the contract shall be used.

AVAILABILITY OF INFORMATION

The company undertakes to always provide the following information to the user:

  • company identity (company name and registered office, register number),
  • contact information that enables the user a quick and effective communication (e-mail, telephone),
  • essential characteristics of the goods,
  • availability of products (each product offered on the website is available within a reasonable time)
  • terms of delivery of products (method, place and deadline of delivery),
  • all prices must be clearly and unambiguously specified and must show whether they already include taxes and transport costs,
  • method of payment and delivery,
  • temporal validity of the offer,
  • the period within which it is possible to withdraw from the contract and conditions for withdrawal; moreover, information about potential costs of returning the product for the buyer,
  • Explanation of the complaint procedure, including all details of the contact person.

USE OF LANGUAGE

The Seller operates with buyers from other countries in the geographical area of ​​Europe in English. It uses the full name and registered office of the company in written communications. When labelling a product, it provides the buyer with the necessary information regarding the characteristics, sales conditions, use and purpose of the product. This information is in English, which buyers from other countries in the geographical area of ​​Europe can understand. Instead of verbal language, the Seller also uses generally understood symbols and images when labelling the products.

The AMAREEN Online Boutique offers the selection of the following languages: Slovenian, Croatian and English. The content of the submitted customer order can be agreed in all these languages.

TYPES OF USERS

By registering at the online boutique AMAREEN one becomes a member of the online boutique AMAREEN. Registered members as well as guests who make a quick purchase and do not need to register before making a purchase have the right to purchase in the online boutique.

Upon registration in the online boutique, the visitor obtains a username that is the same as his e-mail address, and a password. If a user wishes to change his e-mail address or password at any time, he can do so in his user profile.

PRODUCT OFFER

The online boutique AMAREEN offers products of the brand AMAREEN, as well as accessories for children and parents.

Clothing and footwear of the brand AMAREEN are carefully and thoughtfully chosen pieces on the market, which are entirely tailored to the above-standard demands, and our vision of comprehensive tidiness of little girls from head to toe, which we want to share on the market, in cooperation with quality and reputable manufacturers in China (PRC).

Product amounts are presented as retail amounts and include value added tax (VAT), but do not include shipping costs. Amounts may vary based on current promotions and campaigns.

Due to the nature of online business, the offer of products in the online boutique changes and is updated, and therefore errors can occur. In order to eliminate the errors as quickly as possible, the company requests that customers inform them about it via the contact information listed on the website.

COLOUR DEVIATION AND PRODUCT SIZE

The colour of the product published in the AMAREEN Online Boutique may vary from the actual colour of the received product. Colour variations may be due to photos, the use of different display settings, and the use of different devices to access the AMAREEN Online Boutique. Colour variations of the product shall not be considered the subject of a complaint or return of the product.

The size of the product published in the AMAREEN Online Boutique may deviate from the actual size of the received product by up to 10%. Size variations of the product shall not be considered the subject of a complaint.

PRODUCT OPINION

The Seller shall not be responsible for the content of opinions about the product written by the buyers. The Seller shall review and reject opinions that contain obvious untruths, are misleading or offensive before publication. The Seller shall not be responsible for the information in the opinions and disclaims any liability arising from the information in the opinions.

PAYMENT METHODS

The online boutique AMAREEN allows for customers from other countries in geographical area of Europe (except Slovenia and Croatia) the following payment methods:

  • with payment or credit card (Mastercard, Visa, American Express),
  • via the PayPal system.

The company ensures that the customer, in the process of placing an order when concluding a distance contract using electronic means, explicitly confirms that he agrees to the payment by placing an order. The function that triggers the order is marked with the words ”confirm order”. By confirming the order, the consumer assumes the obligation of payment to the company.

PRICES

Prices in the online boutique AMAREEN include Value Added Tax (VAT).

Prices in the online boutique AMAREEN are the same for both registered members and guests.

The Seller will provide the buyer with the final amount, which will include value-added tax (VAT) and the cost of shipping, before agreeing on the content of the order and before the offer becomes binding for the buyer.

The purchase contract between the seller and the buyer is concluded at the moment when the seller confirms the order (the buyer receives an electronic message about the status “The order for youre Little Queen is confirmed.”). From this moment on, all prices and other conditions are fixed and apply to both the company and the buyer.

PROMO CODE

The promo code brings various benefits (product discounts, free shipping etc.) when purchasing and is limited in time. The seller in a way that corresponds to the purpose of the seller’s marketing campaign publishes an active promo code. The seller does not guarantee that there is an active promo code at the time of purchase.

You can find an active code on the first page of the advertisement, in an e-mail or in other media. The code brings various benefits. Any code is always limited in time, but must be redeemed within a limited time, otherwise it is invalid.

A promo code is an alphanumeric string of characters that the user enters before completing an order by entering in the “Promo code” field. After that, the benefit automatically assigned to the coupon is activated in the system and it becomes clear in the product basket that the coupon has been activated.

MAGIC GIFT CARDS

A gift card is a security issued by the Seller in electronic form against payment.

Magic Gift Cards are available in the AMAREEN Online Boutique with the following values:

  • EUR 30.00,
  • EUR 50.00 and
  • EUR 100.00.

Magic Gift Cards with other values ​​do not exist and cannot be purchased or redeemed.

Other special features of Magic Gift Cards:

  • Magic Gift Cards can be sent in electronic form (.pdf) via e-mail to the address of the final recipient, or you can save it on your computer, print it out and personally deliver it to them.
  • Each Magic Gift Card has a unique character code and can only be redeemed once.
  • It is possible to purchase several Magic Gift Cards at the same time.
  • Magic Gift Cards can be paid for via online purchase in two (2) ways:  by payment with credit card (Visa, Mastercard, American Express) or via PayPal.
  • Magic Gift Cards can only be redeemed if the total value of the products is at least 1.00 EUR including VAT higher than the amount of the Magic Gift Card.
  • The cost of delivery cannot be paid with a Magic Gift Card.
  • The Magic Gift Cards can only be redeemed in full. If the value of the purchase is higher than the value of the Magic Gift Card, the holder of the Magic Gift Card must pay the difference in the price.
  • It is not possible to exchange Magic Gift Cards for cash.
  • The holder of a Magic Gift Card can transfer the gift card to a third party without limitations. The transfer is made by handing over the Magic Gift Card. By transferring the rights from the Magic Gift Card, the new holder acquires all the rights that the previous holder had.
  • Nothing may be written, deleted, erased or corrected on the Magic Gift Card. Otherwise, the Magic Gift Card shall be considered invalid. The Seller may refuse to fulfil the obligations from the Magic Gift Card if it is established that the Magic Gift Card is forged, written on or damaged, to the extent that the contents of the Magic Gift Card cannot be understood or more than 49% of the Magic Gift Card is missing. In particular, the unique character code on the Magic Gift Card must remain intact, otherwise it shall be considered invalid and the Seller shall refuse to redeem it.
  • The Magic Gift Card is valid for 1 year from the issuance of the Magic Gift Card, unless otherwise stated on the Magic Gift Card.
  • The Seller shall be obliged to accept the Magic Gift Cards as a form of payment for a purchase via the AMAREEN Online Boutique.
  • The Seller shall allow the buyer to redeem several Magic Gift Cards with a single online purchase.
  • If the order or part of the order is cancelled and the Magic Gift Cards are not redeemed, the Seller will restore the Magic Gift Cards to the buyer. All the buyer has to do is inform the Seller of the codes of their Magic Gift Cards that were not redeemed due to the cancellation of the order and that need to be replaced.
  • The Seller’s obligation concerning the Magic Gift Card terminates when the Seller accepts it as payment for a product, upon the expiration of the Magic Gift Card, or if the Magic Gift Card becomes invalid for the reasons set forth in these Terms and Conditions.
  • Magic Gift Cards are different from promotional codes for discounts. We can make promotional codes available as part of the special promotions and sweepstakes of the AMAREEN Online Boutique. These codes, unlike Magic Gift Cards, cannot be purchased.

Redeeming Magic Gift Cards in the AMAREEN Online Boutique:

  • The buyer selects the product they wish to purchase and adds it to the cart. When the buyer has finished adding products to the cart, they continue by clicking on the “View Cart” or “Prooced to checkout” button.
  • In the “Gift cards” section, the buyer enters the code of the Magic Gift Card in the “Enter the code of the Magic Gift Card” field and confirms it by clicking the “Apply” button. If the buyer wants to redeem several Magic Gift Cards, this step is easily repeated.
  • When the buyer enters the codes from the previous indent, the value of the Magic Gift Cards is automatically deducted from the order price. The amount to be settled remains.
  • By clicking on “Complete the purchase”, the buyer enters personal data and selects the delivery method, specifies the delivery address and selects the payment method. The buyer then places the online order.

PURCHASE PROCEDURE

In the online boutique AMAREEN, the user selects the product and clicks on the “Add to cart” button. The system notifies him that the product has been successfully added to the cart. To continue shopping, he must click the “x” at the top right and return to the online boutique AMAREEN. To complete the purchase, he must click on the right on the “Checkout” link and the system will take him to the shopping cart.

In the online boutique AMAREEN, in the upper right corner, there is a shopping cart icon, in which after clicking on the icon, the user on the right side of the website is shown the products added to the shopping cart while browsing the online boutique. The user clicks on “-” for removing the product from the cart, and a click on the “x” returns him to the online boutique.

To complete the order, the user must select the payment method in the lower right corner. If the user has a valid discount code, he enters it in the appropriate field above the payment option and clicks the “Use coupon” button.

Following, the user submits the required information (e-mail, name, surname, address, address, place, postal code, and telephone number), which the company needs to confirm and complete the order and deliver the products. If the user has not yet applied the promo code, it can be re-entered in the upper right corner of the online boutique AMAREEN. The form allows the user’s data to be saved for the next order.

The user confirms his data by clicking on the “Continue” button and arrives at the page to calculate the cost of delivery. The user can use the GLS delivery service.

The products that the user added to the shopping cart while browsing the online boutique AMAREEN are displayed. The price of the product, the cost of shipping, the value of VAT and the total cost of payment are shown in the shopping cart before the order is completed.

By clicking on the “continue” button, the user arrives at the page where he selects the payment method (debit or credit card (Visa, Mastercard, American Express), Paypal) and fills in the data. He also must specify the address for issuing the invoice. The user confirms the order by clicking on the “Confirm order” button.

The user can view the provided delivery information, the payment method he has chosen and the contents of the shopping cart. If the order has been successfully completed, the online boutique AMAREEN displays the text ”Thank you! The order for your Little Queen has been successfully completed. ”

PURCHASE NOTIFICATION PROCEDURE

After placing the order, the customer receives an e-mail notification “The order for your Little Queen has been successfully completed.” From this moment on, all amounts and other conditions are fix, and apply to both – the seller and the buyer.

The content of the placed order is stored in electronic form on the Seller’s server and shall be made available to the buyer upon their written request.

After shipping the ordered products, the Seller shall send the buyer an e-mail containing the tracking number of the package.

The Seller may call the buyer on the provided contact number to verify the information or to ensure the accuracy of the delivery.

The purchase procedure for legal entities is similar to that for natural persons; it is necessary to complete the form with the company’s contact details and VAT ID number.

CONSUMER’S RIGHT OF WITHDRAWAL FROM THE CONTRACT

The buyer may only inspect and test the received product to the extent strictly necessary to establish the actual situation and as is usual in stores. Any testing that deviates from the above can be considered the use of the product, and the buyer shall be liable for reducing the value of the product in accordance with the ZVPot, if this decrease in value is due to conduct not necessary to determine the nature, properties and performance of the product.

With distance orders, the buyer shall have the right to clearly and unambiguously inform the Seller within fourteen (14) days of receipt of the product that they withdraw from the content of the contract, without having to state the reason for their decision, and return to the Seller at their own expense:

  • the completed FORM, in which the buyer selects the “Refund of purchase price” option,
  • copy of the receipt,
  • unused and undamaged product in the original packaging and
  • product label

The Seller will refund the purchase price for the returned product no later than fourteen (14) days from the receipt of the complete documentation with attachments for the return and an undamaged product in the same quantity, unless the product is destroyed, damaged, lost or its quantity has decreased without the fault of the Seller.

If the buyer returns a damaged product or a product without the original packaging or product label, the Seller may file a claim against the buyer for a refund of the reduced value of the product.

Shipping costs for returning the product are non-refundable and will not be included in the refund.

Upon the withdrawal from the agreement on the content of the placed order, in which a promotional code was used, these funds shall be considered a discount and will not be refunded to the buyer. Only the paid amount of the purchase price with value-added tax (VAT) will be refunded to the buyer.

COMPLAINTS DUE TO MATERIAL DEFECTS

The Seller shall be liable for material defects that the item had when the risk was transferred to the buyer, irrespective of whether the Seller knew of them. The Seller shall also be liable for those material defects that show themselves after the risk was transferred to the buyer if they are the result of a cause that existed prior to this. Insignificant material defects shall not be taken into consideration.

A defect shall be deemed material if:

  • the item does not have the attributes necessary for the customary use or circulation of the thing
  • the item does not have the attributes necessary for the special use for which the buyer bought it, and this was or should have been known to the Seller
  • the thing does not have the attributes and features that were expressly or tacitly agreed upon or prescribed
  • the Seller delivered an item that does not match the sample or model, unless the sample or model was only shown for information purposes.

Pursuant to the ZVPot, the buyer may exercise their rights arising from a material defect if they notify the Seller of the defect no later than two (2) months from the day the defect was discovered and return to the Seller at their own expense:

  • the completed FORM, in which the buyer selects the “Complaint – product warranty” option,
  • copy of the receipt,
  • product in the original packaging and
  • product label

to the contact address of the Seller: DALAS ONLINE d.o.o., Perkova ulica 17,1230 Domžale, Slovenia, Europe.

The Seller will reply to the buyer in writing no later than eight (8) days after receiving the complete documentation with attachments for the enforcement of the complaint – product warranty.

If the buyer has correctly notified the Seller of the defect (and if the Seller acknowledged the defect), they shall have the right to require the Seller to rectify the defect on the product or refund a part of the amount paid in proportion to the defect or replace the defective product with a new faultless product or refund the amount of the paid purchase price. The costs of the material, spare parts, work and shipping of the new product that occur when repairing defects or replacing the product with a new one, shall be borne by the Seller.

WARRANTY

The electronic accessories are covered by a one-year warranty from the date of purchase.

To enforce the warranty, the buyer must return to the Seller at their own expense:

  • the completed FORM, in which the buyer selects the “Complaint – product warranty” option,
  • copy of the receipt,
  • product in the original packaging and
  • product label

The Seller will assess how the issue can be resolved in the shortest possible time and within a maximum of forty-five (45) days from the day the Seller received the request from the buyer to rectify the defect. The costs for the material, spare parts, work and shipping of the new product that occur when repairing defects or replacing the product with a new one, shall be borne by the Seller.

The products are shipped throughout Slovenia, Croatia, and other countries in the geographical area of ​​Europe.
